The Iran-Iraq experience of the settlement of a problem of the war prisoners in 1982 – 2016

The Iran-Iraq War 1980-1988 is considered to be one of the most serious local conflicts in the Middle East region where both Washington and Moscow economic and military strategic interests were closely connected. Maintaining their interest in a confrontation of two main contenders for the leadership role in a region, the Kremlin and the White House launched the wide military support under cover of the political lobby in the international arena while disregarding the worsening of the humanitarian situation of the Iran and Iraq people. While those two super-Powers were trying to strengthen their influence in the Persian Gulf through the victory of one of the conflicting parties, the UN priority goal was solution to the refugee problem and the solution to the question of the exchange prisoners of war.
The article demonstrates the evolution of the Iran-Iraq cooperation in resolving the issue of the classification of POW, set out various approaches to their repatriation through the prism of the promotion work of the International Committee of the Red Cross and the UN Security Council. It is presented the activity of the advocacy organizations of Iran and Iraq with the combatants and related problems of the identification of prisoners with the host country, but not the one, the citizens of which they are. There were determined the results of work of the standing Contact Group for the exchange of prisoners of war and the bodies of the dead mentioning their role in the Iran- Iraq further economic and political cooperation. There were reached certain conclusions, the Iran-Iraq War in 1980 – 1988, has caused several changes in the international humanitarian law system placing not the norms of the Geneva Conventions first, but the interests and wishes of the POW. It is also emphasized the beginning of the trends of cooperation of the United Nations bodies and with the international humanitarian organizations for the minimization of consequences of the conflict.
